In March of 2016 Union leadership was made aware of NRG's third party 'leave management administrator', Metlife providing documents that require Members of Local 459 applying for sick leave to sign forms that include a full release of all medical records.
The Union's attempt to resolve the violation of Article VI through the grievance procedure ultimately advanced to the final step and an Arbitration hearing held on December 6, 2016.
The Arbitrator ruled in the Union's favor as follows; Employees may support a claim for sick leave of any duration by submitting a properly completed 4047 form.
